This page governs permissions for NCK 0.1 materials unless a separately executed written agreement controls. It does not modify the NCK mathematics.
1. Scope and authority
These terms apply to the NCK 0.1 specification, source code, technical implementation, documentation, publications, examples, representations, and other company-controlled NCK materials to the extent protected or licensable under applicable law. The literal file NCK_MATHEMATICS_0.1.md is the sole normative mathematical authority for NCK 0.1. NIR is representation only and has no independent reasoning or semantic authority.
The authoritative mathematical source for Edition 0.1 is identified by SHA-256 a3654fb47d7370211609e5acd4ff4d309bb71185e45d68d19b046429c03261fa.
2. No implied license
Possession, access, download, viewing, reading, citation, storage, indexing, parsing, rendering, translation, conversion, compilation, execution, interoperability, technical availability, or receipt through a third party does not by itself create a license or enlarge an existing permission. Permission exists only to the extent expressly granted by these terms, a controlling written agreement, or rights that cannot lawfully be restricted.
3. Free permitted use
Subject to these terms, individuals, students, educators, independent developers, academic institutions, nonprofit researchers and scientific researchers may access, study, reproduce for internal study, test, teach, criticize, benchmark, translate, and modify NCK materials for personal, educational, academic, scientific, research, evaluation, or genuinely independent non-commercial purposes.
Commercial use below every threshold in Section 5 is also permitted under this License 0.1, provided the use remains compliant with all attribution, provenance, anti-circumvention, redistribution, automated-processing and beneficiary-classification requirements stated here.
4. Classification follows substance
A label does not determine the license category. Classification may follow the real purpose, beneficiary, funding source, sponsor, commissioner, directing party, controlling party, destination, recipient, integration target, or party that materially receives or exploits the result. A university, laboratory, student, nonprofit, contractor, startup, research group or independent developer does not create an exemption when the work is funded, directed, commissioned or materially used for a party whose use requires a commercial license.
5. Commercial licensing thresholds
A separate negotiated commercial license is required when the entity undertaking, controlling, funding, procuring, or materially benefiting from the covered commercial use, or its applicable connected group, meets any one of the following thresholds:

The thresholds are alternatives, not cumulative requirements. Meeting any one threshold triggers the commercial-license requirement.
An organization that first crosses a threshold should contact license@adrenalineusmle.com within 30 days and obtain a separate commercial license within 90 days of the first threshold-crossing event, unless a different written arrangement is agreed.
6. Connected groups, aggregation and anti-fragmentation
Thresholds and use categories may not be avoided by dividing one activity, deployment, project, beneficiary or commercial objective among multiple people, accounts, subsidiaries, affiliates, laboratories, grants, contractors, portfolio entities, special-purpose vehicles, jurisdictions, repositories, APIs, providers, or successive intermediaries. Where entities are under common control or the covered activity is coordinated, funded, directed or materially beneficiary-linked, the relevant activity and applicable financial or user measures may be evaluated on an aggregated basis.
Passive minority investment alone does not automatically aggregate an otherwise independent portfolio company. Aggregation may apply where an investor, fund, parent, controlling shareholder, sponsor or related party directs, conditions, commissions, funds for its own benefit, receives, controls, or materially benefits from the specific covered use.
7. No intermediary, API or research laundering
No permission is created by routing NCK material or a covered implementation through an employee, contractor, consultant, university, laboratory, nonprofit, affiliate, portfolio company, cloud provider, hosted service, API, model provider, research partner or other intermediary. Delegation and outsourcing do not transfer or expand a license.
A party may not obtain an otherwise unauthorized commercial result by causing another person or service to ingest, transform, implement or reconstruct NCK and then returning only a supposedly independent or “clean” result.
8. Technical-form neutrality
A change of technical form does not create a new permission category. These terms apply, where the underlying act requires permission, regardless of whether NCK material or a covered implementation appears as natural-language text, source code, generated code, binaries, bytecode, machine code, ASTs, NIR, embeddings, vector indexes, databases, JSON, YAML, Markdown, PDF, images, firmware, HDL, RTL, FPGA descriptions, silicon-oriented representations, APIs, hosted services, or future equivalent forms.
Translation, summarization, compilation, transpilation, porting, serialization, OCR, code generation, architecture generation, embedding, vectorization, reconstruction or clean-room transformation does not by itself sever provenance or create permission.
9. AI, automated processing and text/data mining
To the maximum extent permitted by applicable law, rights are expressly reserved for automated extraction and analysis, model ingestion, corpus construction, training, pretraining, continued training, fine-tuning, reinforcement learning, preference training, distillation, imitation, synthetic-data generation, benchmark or evaluation-set construction, embedding, vectorization, retrieval augmentation, RAG, memory construction, indexing, reconstruction, architecture inference, code inference, crawling, scraping and equivalent automated processing, except where such activity is expressly permitted by these terms or a separate written agreement.
Routing material through a language model, multimodal model, code model, agent, vector database, RAG system, crawler, browser, search system, hosted inference service, OCR engine, compiler, API or other automated intermediary does not create authorization.
10. Derivatives, reimplementations and redistribution
Permitted modifications, translations, experiments and reimplementations must preserve required rights and provenance notices and may not be represented as the normative NCK mathematics unless they are literally the authoritative source identified by ADRENALINEUSMLE, LLC. Redistribution or provision to another party does not enlarge that recipient's rights. A recipient must independently qualify under these terms or a controlling written agreement.
11. Hardware and silicon
Personal, academic, scientific and below-threshold prototyping of FPGA, RTL, HDL, ASIC or other hardware realizations is permitted subject to these terms. Commercial hardware deployment or distribution by a party that meets any Section 5 threshold requires a separately negotiated commercial license. No hardware translation, synthesis or fabrication step creates an independent authorization route.
12. Attribution and integrity
Public copies or substantial redistributed portions of permitted NCK materials must identify ADRENALINEUSMLE, LLC, the applicable NCK edition, the official terms URL https://adrenalineusmle.com/terms, and rights-reservation token 1114. Where technically practical, preserve the authoritative-source identity and applicable cryptographic hash.
13. Intellectual property reservation
No license is granted to trademarks, trade names, branding, patents, patent applications, or other rights except to the limited extent expressly stated in these terms or a controlling written agreement. Abstract mathematical facts, ideas and concepts remain subject to whatever rights and limitations applicable law provides; these terms do not claim ownership over unprotectable mathematical facts or ideas. Patent rights are reserved only to the extent validly owned or assigned under applicable executed instruments.
14. Compliance, termination and cure
A material breach terminates permissions granted by this license to the extent permitted by law. Where the breach is reasonably curable and does not involve deliberate circumvention, permissions may be restored if the breach is cured within 30 days after written notice from ADRENALINEUSMLE, LLC, unless applicable law or a controlling agreement requires otherwise. Deliberate evasion, laundering, removal of provenance, or continued use after a required commercial license has not been obtained may be treated separately.
15. Disclaimer
NCK materials are provided for research and technology development without warranties of merchantability, fitness for a particular purpose, non-infringement, uninterrupted operation, or error-free behavior, to the maximum extent permitted by applicable law. Users remain responsible for validation, deployment decisions, legal compliance, safety and consequences of their own systems.
16. Non-waivable rights and controlling law
Nothing in these terms eliminates rights, exceptions or defenses that cannot lawfully be waived or restricted. Export, sanctions, transfer, remote-access and technical-assistance requirements remain subject to applicable law. A separately executed written agreement controls to the extent expressly stated in that agreement and permitted by applicable law.

License version: NCK License 0.1. Changes to future versions do not retroactively rewrite separately executed agreements. The current published terms govern uses that expressly incorporate or refer to this version, subject to applicable law.
